Force Majeure


Force Majeure refers to an unforeseeable and uncontrollable event that prevents a party from fulfilling its contractual obligations. In the maritime context, Force Majeure events may include natural disasters, war, piracy, strikes, and government actions. When a Force Majeure event occurs, the affected party may be excused from performance of its obligations under the contract without incurring liability for breach of contract. However, the party must provide notice of the Force Majeure event to the other party as soon as possible. Force Majeure clauses are commonly included in maritime contracts to allocate the risk of unexpected events between the parties.
